The Version 5010 enforcement discretion period ends on June 30, 2012. All HIPAA-covered entities were required to upgrade to Version 5010 by January 1, 2012, however the Centers for Medicare & Medicaid Services’ (CMS) Office of E-Health Standards and Services initiated an enforcement discretion period to give the industry additional time to complete this upgrade, and meet full compliance with the upgraded transaction standards for ASC X12 Version 5010 (Version 5010) and NCPDP Versions D.0 and 3.0.

As of July 1, 2012, all complaints received in CMS’s HIPAA Administrative Simplification Enforcement Tool (ASET) regarding any noncompliance with the updated standards by HIPAA-covered entities will be subject to enforcement action under the existing HIPAA transaction and code set enforcement process.

With less than two weeks remaining, you should be finished with your upgrade to Version 5010. Over the past months, steady progress toward compliance has been made by industry as health plans, clearinghouses, providers, and software vendors have demonstrated broad collaboration to resolve some of the technical challenges affecting implementation.

Entities still experiencing issues regarding use of the Version 5010, D.0 and 3.0 standards in their transactions should refer to their respective vendor, clearinghouse, payer’s Web site, or provider service department for assistance. CMS is committed to helping you successfully upgrade to Version 5010 by providing resources on the CMS ICD-10 Latest News and Version 5010 Web pages.
